New Workplace Air Quality Rules in Ireland

HSA code of practice aimed at protecting employees’ health will apply to all workplaces and is due to be signed into law next year, and businesses must ensure workplace air quality under new rules. An important update from Irelands Health & Safety Authority was published in the Sunday Business Post on Sunday 13th November by political editor, Michael Brennan, regarding the redrafting of the 2007 Safety, Health & Welfare at Work Act. The article reads:

"Businesses are set to face the risk of criminal prosecution for having poor indoor air quality that could lead to the spread of Covid-19 and winter flu.

The Health and Safety Authority (HSA) has drawn up a new code of practice on indoor air quality in the wake of criticism that the previous 17-year-old regulations failed to take account of the threat of airborne viruses to workers.

It states that the code of practice can be used as part of “criminal proceedings” against an employer for failing in their legal duty to provide a safe workplace for their staff.
The 38-page code will apply to all workplaces including schools and nursing homes. It is currently available for public consultation, with the regulations underpinning it due to be signed into law next year."
